Maker of Fireball Cinnamon Whisky is sued around alleged deceptive labels

Sazerac, maker of Fireball, is staying sued in Illinois around alleged deceptive labeling. The company sells compact bottles that contains a shot of the liqueur and small bottles bought in gasoline stations and supermarkets labeled as malt beverages with whiskey flavoring.

Though the label for the photographs says Cinnamon Whisky beneath the brand name name, the other bottles say only Cinnamon. The composition for the fuel station bottles also reads “malt beverage with natural whisky & other flavors and caramel colour.”

“By not which include the term ‘flavors’ after ‘natural whisky,’ purchasers who look carefully will anticipate the distilled spirit of whisky was included as a different component. … When seen jointly with the Fireball distilled spirit brand name, the label misleads people into believing it is or includes distilled spirits,” the class motion lawsuit, submitted by plaintiff Anna Marquez, reads.

Ms. Marquez procured the 99-cent bottles in 2021 and 2022 in Illinois, wherever the situation was submitted. Her class motion match represents North Dakota, Wyoming, Idaho, Alaska, Iowa, Mississippi, Arkansas, Kansas, Arizona, South Carolina and Utah as nicely.
